Please read these Terms of Service (“Terms”) carefully before using the Synergy Fiber website at synergyfiber.com (the “Site”) or any services offered by Synergy Fiber, LLC (“Synergy Fiber,” “we,” “our,” or “us”).

By accessing the Site or using our services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Site and services immediately.

These Terms apply to all visitors, property managers, property owners, developers, residents, and any other party who accesses or uses the Site or services.

Section 1 — About Synergy Fiber

Synergy Fiber, LLC is a building technology company headquartered in Ann Arbor, Michigan. We provide integrated planning, installation, and managed support services for building technology systems — including managed WiFi, access control, security cameras, intercom systems, smart IoT and sensors, AV/TV, and low-voltage infrastructure — primarily for multifamily and student housing properties.

Our registered address is 3131 S.State Street, Suite 306, Ann Arbor, MI 48108.

Section 2 — Use of the site

2.1 Eligibility

You must be at least 18 years of age to use the Site. By using the Site, you represent and warrant that you meet this requirement and that you have the legal authority to agree to these Terms on behalf of yourself or any organization you represent.

2.2 Permitted use

You may use the Site for lawful purposes only and in accordance with these Terms. Permitted uses include:

  • Researching Synergy Fiber's services and solutions
  • Submitting inquiries, consultation requests, or support tickets
  • Accessing property-specific support resources
  • Using the NOI calculator tool for informational purposes
  • Submitting job applications through the Career Center
  • Paying bills through our billing portal

2.3 Prohibited use

You agree not to:

  • Use the Site in any way that violates applicable federal, state, local, or international law or regulation
  • Transmit any unsolicited or unauthorized advertising or promotional material
  • Impersonate Synergy Fiber, a Synergy Fiber employee, another user, or any other person or entity
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
  • Attempt to gain unauthorized access to any part of the Site or its related systems
  • Use any robot, spider, scraper, or other automated means to access the Site
  • Introduce viruses, trojans, worms, or other malicious or technologically harmful material
  • Collect or harvest personal information of other users without their consent
  • Use the Site to send or facilitate fraudulent communications

Section 3 — Services

3.1 Service agreements

The Site provides general information about Synergy Fiber's services and tools to initiate contact with our team. The actual provision of building technology services — including managed WiFi, access control, security cameras, intercom systems, IoT sensors, AV, and infrastructure — is governed by separate written agreements entered into between Synergy Fiber and the applicable property owner, developer, or management company (“Service Agreement”).

Nothing on the Site constitutes an offer to provide services. All services are subject to a signed Service Agreement, site assessment, and mutual agreement on scope and pricing.

3.2 NOI calculator

The NOI calculator tool available on the Site provides rough estimates only. Results are based on the inputs you provide and general assumptions built into the model. They are not a guarantee of financial performance, investment return, or savings. Synergy Fiber makes no representation that the estimates will be achieved. You should not rely on calculator results as financial, investment, or legal advice.

3.3 Support services

Access to Synergy Fiber's 24/7 support desk and property-specific support resources is provided in connection with active service agreements. Property managers and residents accessing support resources must use them only in connection with the property for which services have been contracted.

3.4 Service modifications

Synergy Fiber reserves the right to modify, suspend, or discontinue any feature or aspect of the Site or services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of services.

Section 4 — Accounts and registration

4.1 Account creation

Certain areas of the Site or associated portals may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Synergy Fiber immediately at sales@synergyfiber.com if you suspect any unauthorized use of your account. Synergy Fiber is not liable for any loss resulting from unauthorized use of your account.

4.3 Account termination

Synergy Fiber reserves the right to suspend or terminate your account at any time, without notice, if we reasonably believe you have violated these Terms or applicable law.

Section 5 — Intellectual property

5.1 Ownership

The Site and all of its content — including but not limited to text, graphics, logos, photographs, videos, data, software, and the compilation thereof — are the property of Synergy Fiber or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

5.2 Limited license

Synergy Fiber grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

  • Reproduce, distribute, modify, or create derivative works from Site content
  • Use Site content for commercial purposes without prior written consent from Synergy Fiber
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use data mining, robots, or similar data gathering tools on the Site

5.3 Trademarks

The Synergy Fiber name, logo, and all related product and service names, design marks, and slogans are trademarks of Synergy Fiber, LLC. You may not use any Synergy Fiber trademark without prior written permission. Third-party trademarks referenced on the Site (including partner and vendor names such as Ruckus, Salto, ButterflyMX, Ecobee, Control4, and Cisco) are the property of their respective owners.

5.4 User submissions

By submitting any content to Synergy Fiber — including through contact forms, support tickets, or any other communication channel — you grant Synergy Fiber a non-exclusive, royalty-free, worldwide license to use, reproduce, and process that content for the purposes of responding to your inquiry, delivering services, and improving our operations. You represent that you have all rights necessary to grant this license.

Section 6 — Third-party links and services

The Site may contain links to third-party websites, tools, or services that are not owned or controlled by Synergy Fiber. These links are provided for convenience only and do not imply endorsement, affiliation, or sponsorship.

Synergy Fiber has no control over and assumes no responsibility for the content, privacy practices, or availability of any third-party sites or services. Your use of third-party sites is governed by their respective terms of service and privacy policies.

Section 7 — Payment terms

7.1 Billing portal

Residents and property managers may pay bills through the Synergy Fiber billing portal. All payments are processed by a third-party payment processor. By submitting payment information, you authorize Synergy Fiber and its payment processor to charge the amount due.

7.2 Service fees

Fees for building technology services are set forth in the applicable Service Agreement. Synergy Fiber reserves the right to update fees with notice as specified in the relevant Service Agreement.

7.3 Disputes

If you believe a charge is incorrect, you must notify Synergy Fiber in writing within 30 days of the charge date by contacting us at sales@synergyfiber.com or by calling 734.222.6060. We will investigate and respond within a reasonable time.

Section 8 — Disclaimers

8.1 Site provided “as is”

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

Synergy Fiber does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site.

8.2 No professional advice

Nothing on the Site constitutes legal, financial, investment, engineering, or professional advice of any kind. The NOI calculator and any estimates, projections, or analyses provided on the Site are for informational purposes only. Always consult qualified professionals before making business, financial, or investment decisions.

Section 9 — Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SYNERGY FIBER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF SYNERGY FIBER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SYNERGY FIBER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SYNERGY FIBER IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Synergy Fiber's liability will be limited to the greatest extent permitted by applicable law.

Section 10 — Indemnification

You agree to defend, indemnify, and hold harmless Synergy Fiber and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Site or services in a manner not authorized by these Terms
  • Your violation of any third-party right, including any intellectual property, privacy, or proprietary right
  • Any claim that content you submitted to Synergy Fiber caused damage to a third party

Section 11 — Governing law and dispute resolution

11.1 Governing law

These Terms and any dispute arising out of or related to the Site or services shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.

11.2 Dispute resolution

Before initiating any formal legal proceeding, you agree to contact Synergy Fiber at sales@synergyfiber.com to attempt to resolve the dispute informally. We will make reasonable efforts to resolve disputes through good-faith negotiation within 30 days of notice.

11.3 Jurisdiction

If informal resolution fails, you agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Washtenaw County, Michigan. You consent to the personal jurisdiction of such courts and waive any objection to venue.

11.4 Waiver of class action

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Section 12 — Changes to these terms

Synergy Fiber reserves the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by email or by a prominent notice on the Site.

Your continued use of the Site after any modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Site.

Section 13 — General provisions

13.1 Entire agreement

These Terms, together with our Privacy Policy and any applicable Service Agreement, constitute the entire agreement between you and Synergy Fiber regarding the Site and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

13.3 Waiver

No failure or delay by Synergy Fiber in exercising any right under these Terms will constitute a waiver of that right. Any waiver must be in writing and signed by an authorized representative of Synergy Fiber.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without Synergy Fiber's prior written consent. Synergy Fiber may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.

13.5 Force majeure

Synergy Fiber will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet outages, or governmental actions.
